PeakPulse operates under a strict policy of complying with the United States Digital Millennium Copyright Act (“DMCA”), which provides a framework for copyright holders to request the removal of allegedly infringing content. When a proper and complete takedown request is received, we will act swiftly to disable or remove access to the content that has been identified. This process also includes notifying the uploader and, when legally permitted, sharing a copy of the DMCA notice, including any contact details of the reporting party.

Counter-Notification Process

If you are a user whose content has been affected by such a takedown and you believe the claim was made in error, or that your use qualifies as fair use or is otherwise lawful, you may send us a counter-notification. Your written statement must include:

• A description of the material that has been removed or to which access has been disabled, along with its original URL or other identifiable information.
• Your full name, address, telephone number, and email.
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
• A statement consenting to the jurisdiction of a United States federal district court for your judicial district (or the district where our company is based if you reside outside of the U.S.), and that you agree to accept service of process from the complainant.
• Your physical or digital signature.

Once we have reviewed and accepted the counter-notification, we will notify the party who filed the initial DMCA request. If no legal action is filed by them within the statutory period, access to the content may be restored.
